NRI Ro Khanna, Congressman expressed strong opposition to the executive order, emphasizing its far-reaching impact on legal immigrants. “Trump's order removes birthright citizenship for children born in the U.S. not just to undocumented parents but to 'lawful' immigrants who are temporarily on a student visa, H-1B/H2B visa, or business visa. So much for the pretense that the Republicans are for legal immigration,” he stated.
The decision is particularly concerning for the NRI community, given their significant reliance on H-1B visas. These non-immigrant visas allow U.S. companies to employ highly skilled foreign workers in specialized fields such as technology and engineering. India accounts for the majority of H-1B visa recipients, with thousands of Indian professionals contributing to the U.S. economy each year.
NRI Shri Thanedar, Congressman another prominent lawmaker, vowed to challenge the executive order. “No matter what Donald Trump says or does, birthright citizenship has and will remain the law of the land. I will fight to protect it at all costs,” he affirmed.
NRI Pramila Jayapal, Congresswoman also condemned the order, calling it unconstitutional. “Plain and simple, this is unconstitutional and cannot be done with the stroke of a pen. If enacted, it would make a mockery of our country's laws and the precedents set in the Constitution,” she said.
Legal experts and immigration rights groups have echoed these sentiments, arguing that the order is a clear violation of the 14th Amendment. A coalition of advocacy organizations has already filed lawsuits challenging the executive order, asserting that birthright citizenship is a fundamental right enshrined in the Constitution.
The move has sparked widespread concern among immigrant communities and legal residents who fear the erosion of constitutional protections. Many worry about the uncertainty it creates for future generations of children born to immigrants in the U.S.
As the legal battle unfolds, the executive order is expected to face significant hurdles in the courts. For now, the debate over birthright citizenship underscores the ongoing tensions surrounding immigration policy in the United States.
