NRI Naresh Kumar Nagesvaran Jailed in Singapore for NS Evasion

NRI Naresh Kumar Nageswaran, 28, has been sentenced to 14 weeks in prison by the Singapore High Court for failing to comply with his mandatory National Service (NS) obligations.
Nageswaran left for India with his mother and sister in 2004 and overstayed his exit permit. Despite being notified of his NS obligation at the age of 13, he did not return to Singapore as required. He was arrested at the airport in 2019 after returning five and a half years late.
During his appeal, Nageswaran claimed that he was unaware of the requirement for an exit permit, as his late mother handled official correspondence. However, the court found evidence that he had personally accompanied his uncle to apply for an exit permit in 2012 and signed a letter in 2014 seeking an extension – claims he later denied.
The High Court ruled that defaulting on NS is a strict liability offence, meaning intent or awareness was irrelevant. The judges also noted that Nageswaran’s defence had failed to provide expert evidence to support its claim that he had not signed the 2014 letter.
Since the sentencing guidelines for NS defaulters were established in 2017, 29 people, including Nageswaran, have been sentenced to prison.
