A local court on Wednesday extended till September 1 the judicial custody
of Maninder Pal Singh Kohli, the prime suspect in the rape and murder
of a British teenager.
The Court of Chief Judicial Magistrate
Paramvir Kaur Nijjar also allowed Kohli's medical examination at Government
Medical College and Hospital on request of Kohli's counsel.
The counsel on Wednesday moved an application
that Kohli was "hypertensive and had stones in the gall bladder
for which he requires immediate medical attention" and strongly
opposed the CBI's plea that they needed a week's time to seek clear
instructions from the Centre in this regard.
Talking to reporters outside the Court
complex, Kohli's counsel said the Court had also allowed the application
moved by him for supplying of certain documents pertaining to the case
against his client.
"On August 18 we had moved an application
regarding suppliance of copies of certain documents which pertain to
what (case) stands against Kohli and the warrants of arrest by the court
in England. Also, we had sought the documents pertaining to the case
summary which the British government had given to the CBI here,"
said the counsel engaged by the prime suspect's family.
He said that under Article 22 of the Constitution
his client had a right to know on what basis he had been detained.
"So far they (CBI) have not given
details of the case on the basis of which they are seeking Kohli's detention.
Second, they must also clarify that if Kohli's arrest last month from
Kalimpong has been shown under Section 41 (i) G Cr PC or under the Extradition
Act," he said.
