Speedy justice to NRIs revenue Cases by Ludhiana Court

DEPUTY Commissioner Anurag Verma has directed all SDMs in the district to immediately set up fast track courts of revenue cases of NRIs. The orders have been passed following the directions of the Department of Revenue and Rehabilitation, Judicial Wing.

The directions were passed at a meeting of all SDMs convened today. He said that with a view to providing speedy justice to the NRIs, the revenue fast track courts would function at the lowest revenue court level, that is, in courts of tehsildars and naib tehsildars only for cases where an NRI is a petitioner.

He said that according to the directions, an NRI means a person of Indian origin who is either permanently or temporarily settled outside India, in either case, for or on taking up employment outside India, for carrying on a business or vocation outside India and for any other purpose, in such circumstances as would indicate his intention to stay outside India for an uncertain period.

To efficiently expedite cases, each trial court of the naib tehsildar/ tehsildar shall adopt reasonable time limit in matter of undisputed/unregistered wills in which NRIs have an interest and process of service of respondents in cases of an NRI petitioner would be done through issue of dasti summons, mushtri munadi and registered advertisement simultaneously for its speedy completion.

He said that in case of disputed mutations all parties concerned should be called simultaneously at the same time through service process as mentioned and decide case in one go.

It has been ordered that to avail of this relief, the petitioner NRI should produce the copy of his/her valid passport to prove that he/she is an NRI. An NRI will also be entitled to file his case through special power of attorney, which may bear a special logo of different colour of the NRIs Sabha. Through this attorney, the case will be heard as fast track court case and for pending cases, the revenue court concerned should, after verifying from passport legitimate NRI status of litigant transfer the same to the fast track court for NRI matters and include case in the cause list of NRI matters for expeditious adjudication. The progress of these cases shall be monitored at the level of SDM, district collector and commissioner during monthly/quarterly meetings.
