High Court- for completion of US Jasbir Singh's the statement

On Wednesday, CBI, The Central Bureau of Investigation told the
Delhi High Court that they had recorded the statement of San Francisco-California
based NRI Jasbir Singh, who is a key witness and had allegedly heard
Tytler inciting a mob to kill sikhs. They would submit a report
based on Singh's testimony before the trial court.
On 1st November 1984, 9am, a big mob which was carrying sticks,
iron rods and kerosene oil attacked the Gurdwara. The crowd was
being led by our area Member Parliament of Congress- I Jagdish Tytler.
He incited the crowd to set the Gurdwara on fire and to kill the
Sikhs.
The CBI, following a trial court order directing it to re-investigate
Tytler's role in the case, had issued notice to Jasbir on January
2 last year under Section 160 of the CrPC, which empowers the agency
to seek presence of a witness. Challenging the summons, Singh pleaded,
"If the CBI is really serious and interested in investigating
the case and recording the statement of the witness petitioner,
then it should have moved under section 166A (1)(which allows non-resident
Indian to testify in foreign courts on the request of probe agency)
and not under section 160 of the CrPC.''
On Jan 14, 2008, the Delhi High Court asked CBI to respond to a
petition by a NRI California- based Jasbir Singh who is a key witness
in the 1984 anti-Sikh riots involving Congress leader Jagdish Tytler.
In Dec., 2008, two senior staff members of CBI travelled for USA
to get a statement of Jasbir Singh, who is a key witness and had
allegedly heard Tytler inciting a mob to kill sikhs. The CBI team
recorded the Singh's statement and also to question other 1984 riot
witnesses based in the US.
