Dowry Prohibition act filed against a female for the first time in the Indian legal history

498a, The most misused and abused law by females/in laws in India to extort huge sums of money from NRI’s was Passed by Indian Parliament in 1983, Indian Penal Code 498A, is a criminal law (not a civil law) which is defined as follows,

“Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine. The offence is Cognizable, non-compoundable and non-bailable."

But what about a female and her family who harassed her NRI husband for huge sum of money to keep the marriage alive???

Here’s the answer. Dowry Prohibition act 1961, similar to “OLI” in the olden days.
1. Definition of "dowry"- In this Act, "dowry" means any property or valuable security given or agreed to be given either directly or indirectly-

a. by one party to a marriage to the other party to the marriage; or

b. by the parents of either party to a marriage or by any other person, to either party to the marriage or to any other person, at or before 2[or any time after the marriage] 3[in connection with the marriage of the said parties, which means even a husband can file a case against such evil people.

My name is CS Chandra, resident of United Kingdom. I got married to Sridevi mannava d/o Ram Mohan Rao Mannava & Vijayalakshmi mannava residents of Vijayawada on 31-10-2003. Sridevi mannava was originally caught red handed for illegal internet dating which she claimed as “time pass” with anonymous chatters and she used to meet them secretly to satisfy her sexual thirst.

I have complained the matter to her parents about her sex mania and all of them suddenly changed their attitude and threatened me to stay with her or else they will file 498a and they have asked me to bring my share from my family and transfer on her name. She has harassed me several times to bring the share from my family and not to lookafter my family members. In Laws Mr Ram Mohan Rao & Mrs Vijayalakshmi initially have taken Rs 30 lakh rupees from me by convincing that they will buy a property on my name on the pretext of Real estate boom but finally have used it for themselves.

I couldn’t satisfy their greediness and finally decided for a divorce. They came to know about it and they have filed a false 498a against myself and my old aged sick parents. They have been harassing me for Rs One crore to hand over to them or else they will not with draw the false case. Myself and my family have suffered a lot with their mental torture. During the course I have recorded several telephone conversations which clarify their in satiable demands. I even have several bank statements showing the money transfer from my account to their accounts.

I have successfully filed a dowry Prohibition act in Nellore Court, Andhra Pradesh, on 09-01-2007, with all the evidences of dowry harassment against myself and my family. They came to know about this and are threatening to kill me and abusing me in all possible ways.

This Unique case won lot of peoples appreciation and I sincerely request NRI association to help me to fight against such barbaric acts by indecent wife and her family.
