Manish can go to Delhi high Court/supreme court straight
away and tell everything .The bails are not so difficult
now a days after arrest. Session
judges won't help as the lower courts in India are
crooked,insensitive,blind and run by a large number
of insensitive, clerk minded and corrupt judges,lawyers
and court officials.less said about police the better.They
are arrogant,morally degenerate,kakhi wearing goondas
and bribe collectors,who think they dont live in same
society.All this is just because of 6 weaknesses in
our system &law:
1.vaguely worded clause in CrPC to power to arrest
even without preliminary investigation on suspicion
of committing a crime.This is just sheer nonsense.Malimath
Commitete and many other experts have already recommended
but knowingly Government (read criminals in politics
and bureaucracy and even in Bar are not allowing the
change dragging their feet, because they wont have
harassing power and make money )
2. No financial and penal provisions against malafied
and irregularities in dealing with cases and implicating/arresting/prosecuting
citizens withoutn adequate grounds.
3.Courts not using powers to discharge at challan
filing stage itself cases which have weak evidences
and look manipulated.The courts deliberatley &
knowingly undertake trial of every case police brings.
4.Police organisations are reporting to line executives
in governments.They should report to governors and
be supervised by a citizens council in State having
mix of esteemed persons and Govt babus on penal.
5,Repeated transfers of SPs and senior officers quickly
thus low level policemen like thanedars and ASIs have
free ground to rule .
6.Change in public service rules are overdue where
concept of permanent job has to be dropped and procedure
laid down to discharge corrupt,inefficient and misbehaved
offcials after every 5 years of career scrutiny and
complaints eceived against them from citizens.
If we can do this, then things would fall in place.Let
us all start campaign for these changes.
