    Calling-off-marriage after Engagement Case:
    NRI Father and Son
got bail after spending 3 weeks in jail
    &
agree to a $ settlement if its "full and final"

Every case is different and every individuals story is unique so there are no absolute rights and wrongs while dealing with a NRI's engagement and marriage in India. It entirely depends on the individual, what situation you are in, how vulnerable you are and what you have to lose or gain.

When father and son were arrested four weeks back, NRI's relative were very upset and like to fight back in court to give the lesson to the other party. When judge extended their bail two times, it was shocked whole NRI family. After spending 20 days in jail, NRI Father & Son realized that it is better to make a settlement because Indian court system is not same as in US.

Our press reporter found that both parties agreed to a settlement, compromise or MOU. It would be "Full and Final" settlement with no further claims for any alimony, maintenance and streedhan. No futher judicial litigation by either side with connection of this case.

One NRI relative said, remember its all a power game and what matters is who has control. You will not believe how many dumb asses part with money and still their cases do not get resolved. The simple rule of family law in India is that everything has to be in precise, in black and white and absolute i.e. with the courts cognizance and not subject to any mis-interpretation. Anthing short of this can always be twisted or retracted later on by the girl.

Sukhjinder Singh, a lawyer at Ludhiana said: Never ever agree to a cash settlement that you will give cash as part of any deal. It has to be in the form of a draft. If your CLAWs are sincere about a settlement let them commit in court. Let the girl stand up in court and commit that once she gets this money its all final and over and she has no further claims.

Our senior representative confirmed that judge did not accept bail and postpone their bail hearings until Wednesday, Jan 09. Look at all the injustice that has been meted out to these NRI families and see how some of them were betrayed by someone they considered their own. Feel their pain and the sting of the stab if you can.

On the other hand, Pravasi Bharatiya Divas will be held in Chandigarh on Jan 05 and in Jalandhar on Jan. 06 to attract NRIs for investment. NRI Punjabi community feel an immense urge to do something for the land that has nurtured them.

NRI legislator Jassi Khangura, Qila Raipur MLA in the Punjab Vidhan Sabha has asked the government to deal with NRI problems with earnestness. He made strong appeal to the ruling SAD-BJP, “Please don’t turn the forthcoming Punjabi NRI sammelan to be held at Chandigarh and Jalandhar on January 5 and 6 into a sweet-talking shop, oblivious of the needs of the NRI community.”

President Kehar Singh Gill and general secretary Inderpal Singh Athwal, who have led a 150-member delegation from Canada to the Punjabi NRI sammelan being held on January 5 and 6 here, said, "The sabha formed to assist the NRIs has failed in achieving any significant results owing to mismanagement and the functioning of the organisations was far from being transparent or satisfactory."

Since yesterday, telephone started ringing from San Francisco, Vancouver to New York for help to NRIs who were arrested four days ago for refusing to marry a girl after engagement in Feb. 2006.

Few hours back, our senior representative talked to their nearest relative in Punjab and he describe like this:

In Feb. 2006, Ajit Singh from North Carolina, along with his family went to Jallandhar, Punjab, India to find a good Indian Punjabi cultured girl match to start a new and a happy life. The family hails from Begowal town in Nawanshahar district. Ajit's father Charanjit Singh was approached by Kashmiri Chand from Ludhiana to meet girl's father Paramjit Singh who was also living in same colony. After few meetings, engagement was done in banquet hall. As usual punjabi tradition, gold rings and other simple ceremony was performed.

Ajit' fiancee was going to college in BA part one but still she had one subject failed in school to be graduate. According to sources, she could not pass 2nd time and middle man lie that she had gone through. For the past one and half years, both sides were very happy to fix a marriage in Dec. 2007.

Ajit Singh's father went to India on Nov. 03, 2007 to prepare and help for marriage ceremony. With the request of Ajit, father Charanjit Singh requested middle man to bring all education papers before marriage. The middle man could not produced any thing because he lied. Charanjit Singh insist that his son wants all education papers. Within few weeks, the conversations between the parties became unfavorable to fix any marriage date. At the end Ajit refused to marry this girl because of all lies. The Middle man started to convey messages as a threat.

Ajit Singh and his father, Charanjit Singh, thought that they had the right to refuse them because of all lies. On the other hand, girl's father who is working in police as constable felt insult and used his influence to take a action.

The girl's father Paramjit Singh, who lives near Karabara Chowk, registered a case with the local police station, alleged that his daughter got engaged to Ajit in February 2006, Ajit and his family began demanding a car as dowry soon after the engagement. Paramjit Singh further alleged that later the boy’s family took away some jewellery of his daughter. He also said, in the complaint, that the boy’s family later refused to marry their son with his daughter. Left with no option, he reported the matter to the police, the complaint further states.

Salem Tabri Station House Officer Beant Kumar Juneja said the girl’s family had complained the matter to the police recently. The SHO confirmed that after registering the case yesterday, the police today arrested Ajit Singh and Charanjit Singh.

NRI Ajit’s mother, Gurmej Kaur too, has been charged but not booked. Father and son were arrested under 406 and 420. The police got judicial remand. On Friday, the relatives were trying to get bail of NRI son and father but special judge who had a authority for bail, did not come to the court.

NRI protection Agency's representative said:

  • Is calling off a marriage a sin ?
  • Is a girl's father complaint good enough to land a man and his relatives in jail ?
  • What happens to all women who call off marriages ?
  • Can 406 and 420 be used, if 498A is not applicable?
