Gutkha baron Rasiklal Manikchand Dhariwal may be
sitting pretty in Dubai but he is accessing the highest
court to strike down the non-bailable warrant issued
against him by a special trial court judge. And representing
him on Friday in the Supreme Court would be two legal
heavy weights Harish Salve and Arun Jaitley.
While J M Joshi, owner of Goa Gutkha has submitted
himself to questioning by CBI in the gutkha barons-underworld
nexus case, Dhariwal who is under a NRI shield right
now has challenged the Bombay High Court order that
upheld the warrant issued against him.
Dhariwal's new arsenal is that the special judge
handling cases under the stringent law dealing with
organised crime in Maharashtra did not have a jurisdiction
to issue warrants against a person who was residing
abroad. His other legal arguments are what were placed
before the HC and rejected. His plea is that the the
warrant could be issued only against an accused and
not to get a person for a police interrogation.
